Article 8 - Public officials and employees shall respect the exercising of the right of petitioning, as long as it is formulated, by writing, in a calm and respectful manner. However, in political matters only citizens of the Republic shall have use of this right.
 

To each petition to whom it is directed, the authority has the obligation to respond to the petitioner. There should be a brief written reply by the authority.

ARTICULO 7o.- ES INVIOLABLE LA LIBERTAD DE ESCRIBIR Y PUBLICAR ESCRITOS SOBRE CUALQUIERA MATERIA. NINGUNA LEY NI AUTORIDAD PUEDE ESTABLECER LA PREVIA CENSURA, NI EXIGIR FIANZA A LOS AUTORES O IMPRESORES, NI COARTAR LA LIBERTAD DE IMPRENTA, QUE NO TIENE MAS LIMITES QUE EL RESPETO A LA VIDA PRIVADA, A LA MORAL Y A LA PAZ PUBLICA. EN NINGUN CASO PODRA SECUESTRARSE LA IMPRENTA COMO INSTRUMENTO DEL DELITO.

LAS LEYES ORGANICAS DICTARAN CUANTAS DISPOSICIONES SEAN NECESARIAS PARA EVITAR QUE SO PRETEXTO DE LAS DENUNCIAS POR DELITOS DE PRENSA, SEAN ENCARCELADOS LOS EXPENDEDORES, "PAPELEROS", OPERARIOS Y DEMAS EMPLEADOS DEL ESTABLECIMIENTO DONDE HAYA SALIDO EL ESCRITO DENUNCIADO, A MENOS QUE SE DEMUESTRE PREVIAMENTE LA RESPONSABILIDAD DE AQUELLOS

Article 7 - The freedom to write and publish on any matter is inviolable. No law or authority may establish prior censorship, or require bond from authors or printers, or abridge the freedom of printing, which has no limit but the respect of private life, of morals, and of public peace. In no case may the press be seized as an instrument of crime. Organic laws will specify what measures are necessary to assure that, under the pretext of denouncing crimes of the press, distributors, operators, and other employees from which the denounced writing has emanated, will not be jailed, unless there is prior proof of the employees' guilt.

ARTICULO 6o.- LA MANIFESTACION DE LAS IDEAS NO SERA OBJETO DE NINGUNA INQUISICION JUDICIAL O ADMINISTRATIVA, SINO EN EL CASO DE QUE ATAQUE A LA MORAL, LOS DERECHOS DE TERCERO, PROVOQUE ALGUN DELITO, O PERTURBE EL ORDEN PUBLICO; EL DERECHO DE REPLICA SERA EJERCIDO EN LOS TERMINOS DISPUESTOS POR LA LEY. EL DERECHO A LA INFORMACION SERA GARANTIZADO POR EL ESTADO.

PARA EL EJERCICIO DEL DERECHO DE ACCESO A LA INFORMACION, LA FEDERACION, LOS ESTADOS Y EL DISTRITO FEDERAL, EN EL AMBITO DE SUS RESPECTIVAS COMPETENCIAS, SE REGIRAN POR LOS SIGUIENTES PRINCIPIOS Y BASES: 

 I. TODA LA INFORMACION EN POSESION DE CUALQUIER AUTORIDAD, ENTIDAD, ORGANO Y ORGANISMO FEDERAL, ESTATAL Y MUNICIPAL, ES PUBLICA Y SOLO PODRA SER RESERVADA TEMPORALMENTE POR RAZONES DE INTERES PUBLICO EN LOS TERMINOS QUE FIJEN LAS LEYES. EN LA INTERPRETACION DE ESTE DERECHO DEBERA PREVALECER EL PRINCIPIO DE MAXIMA PUBLICIDAD. 

 II. LA INFORMACION QUE SE REFIERE A LA VIDA PRIVADA Y LOS DATOS PERSONALES SERA PROTEGIDA EN LOS TERMINOS Y CON LAS EXCEPCIONES QUE FIJEN LAS LEYES. 

 

III. TODA PERSONA, SIN NECESIDAD DE ACREDITAR INTERES ALGUNO O JUSTIFICAR SU UTILIZACION, TENDRA ACCESO GRATUITO A LA INFORMACION PUBLICA, A SUS DATOS PERSONALES O A LA RECTIFICACION DE ESTOS. 

 IV. SE ESTABLECERAN MECANISMOS DE ACCESO A LA INFORMACION Y PROCEDIMIENTOS DE REVISION EXPEDITOS. ESTOS PROCEDIMIENTOS SE SUSTANCIARAN ANTE ORGANOS U ORGANISMOS ESPECIALIZADOS E IMPARCIALES, Y CON AUTONOMIA OPERATIVA, DE GESTION Y DE DECISION.

 

 V. LOS SUJETOS OBLIGADOS DEBERAN PRESERVAR SUS DOCUMENTOS EN ARCHIVOS ADMINISTRATIVOS ACTUALIZADOS Y PUBLICARAN A TRAVES DE LOS MEDIOS ELECTRONICOS DISPONIBLES, LA INFORMACION COMPLETA Y ACTUALIZADA SOBRE SUS INDICADORES DE GESTION Y EL EJERCICIO DE LOS RECURSOS PUBLICOS.

 VI. LAS LEYES DETERMINARAN LA MANERA EN QUE LOS SUJETOS OBLIGADOS DEBERAN HACER PUBLICA LA INFORMACION RELATIVA A LOS RECURSOS PUBLICOS QUE ENTREGUEN A PERSONAS FISICAS O MORALES. 

 VII. LA INOBSERVANCIA A LAS DISPOSICIONES EN MATERIA DE ACCESO A LA INFORMACION PUBLICA SERA SANCIONADA EN LOS TERMINOS QUE DISPONGAN LAS LEYES.

ARTICULO 5o.-

 

A NINGUNA PERSONA PODRA IMPEDIRSE QUE SE DEDIQUE A LA PROFESION, INDUSTRIA, COMERCIO O TRABAJO QUE LE ACOMODE, SIENDO LICITOS. EL EJERCICIO DE ESTA LIBERTAD SOLO PODRA VEDARSE POR DETERMINACION JUDICIAL, CUANDO SE ATAQUEN LOS DERECHOS DE TERCERO, O POR RESOLUCION GUBERNATIVA, DICTADA EN LOS TERMINOS QUE MARQUE LA LEY, CUANDO SE OFENDAN LOS DERECHOS DE LA SOCIEDAD. NADIE PUEDE SER PRIVADO DEL PRODUCTO DE SU TRABAJO, SINO POR RESOLUCION JUDICIAL.

LA LEY DETERMINARA EN CADA ESTADO CUALES SON LAS PROFESIONES QUE NECESITAN TITULO PARA SU EJERCICIO, LAS CONDICIONES QUE DEBAN LLENARSE PARA OBTENERLO Y LAS AUTORIDADES QUE HAN DE EXPEDIRLO.

NADIE PODRA SER OBLIGADO A PRESTAR TRABAJOS PERSONALES SIN LA JUSTA RETRIBUCION Y SIN SU PLENO CONSENTIMIENTO, SALVO EL TRABAJO IMPUESTO COMO PENA POR LA AUTORIDAD JUDICIAL, EL CUAL SE AJUSTARA A LO DISPUESTO EN LAS FRACCIONES I Y II DEL ARTICULO 123.

EN CUANTO A LOS SERVICIOS PUBLICOS, SOLO PODRAN SER OBLIGATORIOS, EN LOS TERMINOS QUE ESTABLEZCAN LAS LEYES RESPECTIVAS, EL DE LAS ARMAS Y LOS JURADOS, ASI COMO EL DESEMPEÑO DE LOS CARGOS CONCEJILES Y LOS DE ELECCION POPULAR, DIRECTA O INDIRECTA. LAS FUNCIONES ELECTORALES Y CENSALES TENDRAN CARACTER OBLIGATORIO Y GRATUITO, PERO SERAN RETRIBUIDAS AQUELLAS QUE SE REALICEN PROFESIONALMENTE EN LOS TERMINOS DE ESTA CONSTITUCION Y LAS LEYES CORRESPONDIENTES. LOS SERVICIOS PROFESIONALES DE INDOLE SOCIAL SERAN OBLIGATORIOS Y RETRIBUIDOS EN LOS TERMINOS DE LA LEY Y CON LAS EXCEPCIONES QUE ESTA SEÑALE.

EL ESTADO NO PUEDE PERMITIR QUE SE LLEVE A EFECTO NINGUN CONTRATO, PACTO O CONVENIO QUE TENGA POR OBJETO EL MENOSCABO, LA PERDIDA O EL IRREVOCABLE SACRIFICIO DE LA LIBERTAD DE LA PERSONA POR CUALQUIER CAUSA.

TAMPOCO PUEDE ADMITIRSE CONVENIO EN QUE LA PERSONA PACTE SU PROSCRIPCION O DESTIERRO, O EN QUE RENUNCIE TEMPORAL O PERMANENTEMENTE A EJERCER DETERMINADA PROFESION, INDUSTRIA O COMERCIO.

EL CONTRATO DE TRABAJO SOLO OBLIGARA A PRESTAR EL SERVICIO CONVENIDO POR EL TIEMPO QUE FIJE LA LEY, SIN PODER EXCEDER DE UN AÑO EN PERJUICIO DEL TRABAJADOR, Y NO PODRA EXTENDERSE, EN NINGUN CASO, A LA RENUNCIA, PERDIDA O MENOSCABO DE CUALQUIERA DE LOS DERECHOS POLITICOS O CIVILES.

LA FALTA DE CUMPLIMIENTO DE DICHO CONTRATO, POR LO QUE RESPECTA AL TRABAJADOR, SOLO OBLIGARA A ESTE A LA CORRESPONDIENTE RESPONSABILIDAD CIVIL, SIN QUE EN NINGUN CASO PUEDA HACERSE COACCION SOBRE SU PERSONA.
